A fireworks factory owner has been accused of manslaughter after two firemen died in a major explosion that occurred at the factory in December 2006. The blast also resulted in injuries, and 20 people were injured.

The people who died were Fireman Geoff Wicker and support officer Brian Wembridge.

The blast took place at Festival Fireworks UK Ltd (now called Alpha Fireworks Ltd) based in East Sussex.

The factory is owned by one Martin Winter, who was accused of gross negligence as he was well aware of the fact that a metal container that was stored with fireworks could explode and kill many people in the event of a fire breaking out. Workers used the container to stack those fireworks that were to be exported in a few days.

According to eyewitness accounts, a fire suddenly broke out at the factory and soon engulfed the entire factory. The spread was quite sudden, as the factory contained fireworks, which are regarded to be highly combustible.

People from the fire department arrived at the scene and decided to evacuate the area. They were about to retreat, but many fire officers were still dangerously close to the fire site, and Mr Wembridge was one of them. He was filming the fire and the rescue operation and was accompanied by Mr Wicker.

Mr Wembridge’s camera had captured the crucial moments of the explosion. The film revealed that the blast was so strong that the metal doors of the container were blown apart by the impact.

The prosecution took place at Lewes Crown Court. Alpha Fireworks Ltd was accused of violating health and safety legislation. The owner’s son Nathan faces two charges of manslaughter. The jury will give its verdict next week.

According to defence lawyers, the company was not responsible for the deaths, because the fire fighters had not withdrawn from the area in spite of knowing that an explosion could occur at any moment.

West Midlands Ambulance Service NHS Trust has compensated a community paramedic named Michael Kirkham who was employed by Staffordshire Ambulance Service for permanent disabilities resulting from a fall while he was on duty. Staffordshire Ambulance Service has now merged into West Midlands Ambulance Service.

The community paramedic was on call for emergencies arising from doctor’s surgeries and he was attending one such call when the accident happened. He was leaving a patient’s house when his equipment bag caught on the door handle of the patient’s front door. The resulting thrust pulled him down and he suffered serious injuries on his shoulder.

Kirkham was diagnosed with severe shoulder injury and he had to spend four weeks in bed rest to let his shoulder heal so that he could return to his duties. However, he later developed severe pain in his back and limbs and was forced to use a walking stick to move around. When he started experienced loss of feeling in his arm, he had to quit his job. The accident has thus left him almost crippled and has compromised his mobility to a great extent.

Kirkham said that he had previously brought to the employer’s notice that his equipment bag was very heavy and not easy to carry. The weight of the bag has been reduced after the accident and the bag has been changed to a more manageable rucksack.

Kirkham was awarded damages of £200,000 after West Midlands Ambulance Service NHS Trust admitted liability and agreed to settle the claim out of court. The ambulance service spokespersons said that the incident is quite unfortunate and that safety precautions will be taken to ensure that such accidents do not happen in future.

The accident occurred in October 2007 when Sharon Kerry, the hostel duty officer for the council, was placing some money inside a safe. However, the council had failed to act on the issue.

After the accident, Kerry contacted her union, the GMB, which asked Thompsons Solicitors to act upon the case. However, the council accepted liability for Kerry’s injury and agreed to pay her a compensation of 10,250 pounds in an out of court settlement.

Andy Worth of the GMB said the position of the safe should have been assessed for risk and that measures should have been taken in accordance with the findings. He added that the council should have acted upon the complaints of the employees and moved the safe to a better location where they could use it without strain. He also revealed that the back damage to Kerry has been so severe that she may have to undergo surgery.
